Civil Rights Act of 1875

The Civil Rights Act of 1875 (18 Stat. 335) was a federal law proposed in the United States by Republican Senator Charles Sumner, along with Republican Congressman Benjamin Franklin Butler . It was passed by Congress on March 1, 1875 and signed by President Ulysses S. Grant .

The content was equal access to all public facilities (e.g. hotels, railways, ferries, theaters, etc.) regardless of race, skin color or previous slave status. The Supreme Court of the United States (separate opinion with dissenting decision by John Marshall Harlan ) declared the 1883 Act unconstitutional on the grounds that Congress had no powers to regulate the behavior of individuals. The 14th Amendment prohibits by former Court considers bypassing the civil rights only by the state, but not by individuals.
