Business trip

In Germany, business trips are a term used in travel expense law.

Federal law

Site work, identified by the Federal Travel Expenses Act (BRKG) in the version of 20 March 1965 (a. F.) courses or trips on services or place of residence to the execution of official business outside the service facility (§ 2 para. 3 BRKG a. With the new version of the Federal Travel Expenses Act as of September 1, 2005, the concept of business trips was omitted from federal law. Since then, official business at the place of work or residence, but outside the place of work, has also been covered by the term business trip.

Business trips had to have been ordered or approved by the responsible department, unless an order or approval according to the office in the legal sense of the business traveler or the nature of the business was out of the question (Section 2 (3) BRKG old version) . The place of residence was equivalent to a place serving the temporary residence (ibid.).

Business trips were also corridors or trips to neighboring locations to carry out official business, since according to the Federal Travel Expenses Act a. F belonged to the place of residence, work or business. Neighboring locations were defined as communities or parts of those that are spatially, economically and traffic-wise closely related to one another and that the Federal Minister of the Interior had declared to be neighboring locations by means of a statutory order .

For business trips (as well as business trips of up to five hours duration), reimbursement of travel expenses (Section 5 BRKG old version), mileage and transport allowance (Section 6 BRKG old version) and reimbursement of additional costs (Section 14 BRKG old version) were due ( 15 BRKG old version). In addition, the proven necessary expenses for food and accommodation were reimbursed, taking into account the domestic savings (ibid.).

State law

In the federal states' travel expense law , the concept of business trips lives on in some cases, e.g. B. in Baden-Württemberg and North Rhine-Westphalia . There, as in federal law, it designates corridors or trips to carry out official business at the place of work or residence outside the place of work.
