The federal popular initiative "Against arms exports to civil war countries (correction initiative)" is a popular initiative launched by the Alliance against arms exports to civil war countries in December 2018. The collection of signatures runs until June 11, 2020. The initiative aims to regulate the principles of arms export policy at constitutional level . Arms exports to countries that are involved in conflicts or human rights violations are to be restricted. These provisions are currently regulated by the Federal Council at ordinance level . Following the popular initiative “For a ban on the export of war material” , he allowed the export of weapons, provided they were not used for serious human rights violations. In the summer of 2018, he refrained from further easing due to widespread criticism. The initiative is supported by several parties ( BDP , GLP , SP , GPS ) as well as numerous non-governmental organizations .

According to the initiators, 100,000 signatures had already been collected by February 2019.

Initiative text

The federal constitution is amended as follows:

Art. 107 paras. 2-4

  1. It [the federal government] issues regulations in the form of a federal law on the production, procurement and distribution as well as on the import, export and transit of war material.
  2. Foreign trade in war material is particularly prohibited if:
a. the country of destination is involved in an internal or international armed conflict; the law can provide for exceptions, in particular for:
1. Democratic countries that have an export control regime that is comparable to that of Switzerland,
2. Countries that are involved in such conflicts exclusively within the framework of a resolution of the Security Council of the United Nations Organization;
b. the country of destination systematically and seriously violates human rights;
c. there is a high risk in the country of destination that the war material will be used against the civilian population; or
d. in the country of destination there is a high risk that the war material will be passed on to an undesired final recipient.
  1. Notwithstanding paragraph 3, the law can provide for exceptions for devices for humanitarian demining and for individual handguns and handguns with the associated ammunition, provided the weapons are used exclusively for private or sporting purposes.

  1. Transitional provision to Art. 107 paras. 2-4 (weapons and war material)
If the relevant statutory provisions do not come into force within three years of the acceptance of Article 107 paragraphs 2–4 by the people and the cantons, the Federal Council shall issue the necessary implementing provisions by ordinance; these apply until the statutory provisions come into force.
