FIDIC

from Wikipedia, the free encyclopedia

The FIDIC , Fédération Internationale des Ingénieurs Conseils (French) or International Federation of Consulting Engineers (English) is the most important international umbrella organization of national associations of consulting engineers in the construction industry . FIDIC has its office in Geneva , Switzerland .

aims

The association's statutory purpose is to represent a large number of consulting engineers or engineering companies internationally through national member associations, to support members with solutions for business practices, to define and promote professional rules (code of ethics), to improve the reputation of the consulting engineer and promote the commitment of members to sustainable development.

The German member association of FIDIC is the Association of Consulting Engineers (VBI).

FIDIC contracts

As part of this activity, she developed the FIDIC construction contracts as standardized model contracts for international construction projects. These contract models have a similar meaning internationally as the VOB / B in the German market . They are based on the Anglo-Saxon legal system, but are designed in such a way that recourse to national statutory provisions can be avoided as far as possible through very comprehensive and detailed contractual regulations. They are therefore particularly suitable for large-scale construction projects with international participants. The FIDIC contracts are often prescribed or recommended when awarding contracts that the World Bank , other multilateral development banks and the EU finance (approx. USD 25 to 40 billion annually). In Eastern Europe in particular, they are often used for privately financed investments.

The current contract models (new edition from 1999) are:

  • Conditions of Contract for Construction for Building and Engineering Works Designed by the Employer, "Red Book"
  • Conditions of Contract for Plant and Design-Build for Electrical and Mechanical Plant and for Building and Engineering Works Designed by the Contractor, "Yellow Book"
  • Conditions of Contract for EPC / Turnkey Projects, "Silver Book"
  • Short form of contract, "Green Book"

The short names each developed from the color of the cover. The Association of Consulting Engineers VBI has developed German-language working aids for the essential FIDIC contract models in order to make it easier for German companies to deal with the matter. A seminar program also serves this purpose. a. leads to the qualification as FIDIC adjudicator.

The contract types differ mainly in the type of construction project for which they are to be used. The use of the Red Book is suitable for projects in which the client provides the essential planning services, whereas the Yellow Book is suitable for projects in which the contractor is primarily responsible for planning. The Silver Book is suitable for turnkey construction; Finally, the Green Book is to be used when it comes to simpler construction projects with a low order volume and a relatively short construction period. The following sample contracts are also available, such as B.

  • Client-Consultant Agreement (White Book)
  • Sub-Consultant Agreement
  • Joint venture agreement.
