Specialist lawyer for sports law
The specialist lawyer for sports law is a designation for lawyers introduced by the 6th constitutional assembly of the Federal Bar Association by resolution of November 26, 2018. The corresponding amendment to the Specialist Lawyers Act (FAO) came into force on July 1, 2019.
Lawyers can apply to their competent bar association to be allowed to use this specialist lawyer designation if they have proven their special knowledge of sports law , which is usually done through a specialist lawyer course of at least 120 hours plus the passing of at least three exams with a total duration of at least 15 hours. In addition, practical experience must be proven by proving at least 80 cases in sports law within three years, of which at least 20 must be legal proceedings (sports association court proceedings, other court proceedings, out-of-court appeals, conciliation or arbitration proceedings). The cases must relate to at least three different areas of § 14q No. 1.3 to 11 FAO, with at least five cases to each of these areas.
According to § 14q FAO new version, special knowledge in the areas of sports law must be proven
- 1. Self-imposed right of the sports associations within the framework of the statute autonomy and their organizational structures, in particular statutes and statutes of national and international sports associations
- 2. National and international sports associations and arbitration
- 3. Sports law references to administrative offense and criminal law, criminal procedure law as well as interstate and international law
- 4. Protection against sports manipulation, in particular through so-called doping , sports law references to pharmaceutical law
- 5. Association law and basic features of company law
- 6. Sports law references to media law , in particular television, internet and radio rights
- 7. Intellectual property law, in particular personal rights as well as copyright and trademark law
- 8. Right of sponsorship , right of state sports funding and subsidy law , sports betting law
- 9. Sports law references to national and international liability law
- 10. Fundamentals of charitable and donation law
- 11. Sports contract law, sports law references to service and employment contract law
