The Federal Register ( German  Federal Register ), short- FR or Fed. Reg. , Is the official gazette of the federal government of the United States of America. This is where federal authorities publish administrative regulations , proposed administrative regulations and notices. With the exception of federal holidays, the FR is published daily. The final rules published in the FR are finally summarized as a collection of laws in the annually updated Code of Federal Regulations (CFR) and published as codified law .

The FR is compiled by the Office of the Federal Register under the National Archives and Records Administration and printed by the Government Printing Office . The publications are not copyrighted as work of the US government . The usual citation is [edition] FR [page number] ([date]), for example 65 FR 741 (Jan. 6, 2000).

Content

The FR is the official channel through which the government notifies changes in requirements, rules and regulations. The notification and commenting process laid down in the Administrative Procedure Act enables citizens to participate in the formulation of the regulations ( Rules, Final Rules , etc.). The publication in the FR constitutes a constructive notice , the contents are judicial notices .

The FR is the primary publication by US federal agencies for

  • Proposed "Rules" and Regulations ( Proposed rules )
  • Final rules
  • Changes to existing rules
  • Announcements of meetings and arbitration adjudicatory proceedings
  • Presidential documents including Executive Orders , Proclamations and Administrative Orders .

Both Proposed Rules and Final Rules are published in the FR. A display on the proposed regulation creating ( Notice of Proposed Rulemaking, NPRM ) asks for public input and comments on proposed regulations and reports any public meetings where the proposed regulation is discussed. The submitted comments are taken into account by the issuing authority and the text of a Final Rule (the final regulation) is published in the FR together with the discussion of the comments. Any authority that proposes regulations in the FR must provide the population with contact information for people and organizations wishing to comment on Proposed Rules or Interim Final Rules (valid regulations for which amendments can still be made).

The United States Government Manual is published as a special edition in the FR. The focus of this publication is on programs and activities.

Each printed daily edition of the FR is divided into four sections:

  • Presidential documents ( executive orders and presidential publications )
  • Rules and regulations (including directional documents and interpretations of the rules by federal authorities)
  • Proposed Rules (including petitions from the public to authorities)
  • Notifications (planned public hearings or meetings)

The final rules first published in FR are finally organized according to topic or overarching topic in the Code of Federal Regulations (CFR), which is updated annually , and thus become a legal source .

Availability

Current and older editions of the FR can be obtained from the Government Printing Office . A subscription can be ordered with a form in each FR. In 2014, an annual subscription was $ 929. Individual editions cost between USD 11 and USD 33, depending on the number of pages. Virtually every legal library affiliated with the American Bar Association has a set of the journal available. Free access

The FR has been available online since 1994. Federal Depository Libraries in the US receive copies of the text either on paper or as microfiches . Some large libraries outside of the United States also have the FR in their holdings.

As part of the eGovernment eRulemaking Initiative , the Regulations.gov website was launched in 2003 to provide easy public access to government documents and projects. A FR document was also published there. Interested parties can use Regulations.gov to access all correspondence relating to the drafting of official regulations and can also comment online. In order to support the authorities in managing these possibilities, the United States Government Printing Office, Federal Docket Management System (FDMS) was also introduced in 2005 . It represents the regulatory side of Regulations.gov.

In April 2009, a freely accessible and searchable website was launched for Federal Register articles from 1996 to the present.

The FR publication system was established on July 26, 1935 with the Federal Register Act .

The first edition of the FR was published on March 16, 1936. In 1946, the Administrative Procedure Act increased the publication requirements for authorities so that they had to publish more of their regulations in the FR.

On March 11, 2014, Darrell Issa introduced the Federal Register Modernization Act (HR 4195; 113th Congress) as a bill in parliament . The law aims to publish the FR primarily electronically and to make the paper version chargeable. This proposal was vehemently rejected by the American Association of Law Libraries (AALL) because it would make citizens' right to information more difficult and documents more difficult to find. According to AALL, a survey found that members of the public, librarians, researchers, students, lawyers and small businesses rely on the printed version. In addition, giving up the printed version would make it impossible for the 15% of Americans who do not use the Internet to access the material. The legislative initiative was voted on in parliament on July 14, 2014 and the law was approved with 386 votes to 0.
