Night mailbox

A deadline mailbox , also known as a night mailbox , is a special mailbox in which the mail that is dropped in is separated from the mail that is dropped in before midnight. It is used by authorities and courts in order to be able to check upon receipt of documents whether statutory or set deadlines have been observed.

These mailboxes are usually labeled with the word "Nachtbriefkasten" , with the note "For post keeping within the deadline " or the like. The only mailbox in a court is usually this mailbox. This does not always apply to branch offices of courts.

sense

In the case of deadlines, the night mailbox therefore proves to which the legal consequences (legal effects, for example the admissibility or inadmissibility of an appeal such as an appeal or an appeal in civil matters ) are linked, whether the receipt took place on a certain day and thus on time or too late was. Since such legal deadlines cover the entire day - i.e. not just the business hours, as is usually the case with deadlines set by business partners among themselves - they also only end at midnight. This means: every written submission received by 23:59 and 59 seconds has been received on time. What is received after 00:00, however, is late.

functionality

A night mailbox usually works in such a way that a flap is coupled to a clock. At exactly midnight, the clock triggers a mechanism so that a flap falls on the mail that has been received by then. This means that in the morning, when the court guards remove the mail, it can be seen exactly which mail - namely everything that is under the flap - was received the day before. This is then also provided with the receipt stamp of the previous day and thus sorted into the files. Everything that is on top of the flap in the mail is then apparently received after midnight of the new day and receives the receipt stamp of the current day.
