Functional reform

As functional reform refers to the transfer of functions to another administrative bodies , it is not on the same administrative level as the previous administrative support. The term "functional" reform is derived from the function that the administrative body or the administrative level have in the overall structure of the public administration bodies.

Examples:

If tasks within an administration are shifted between departments (e.g. between state authorities ) this is not referred to as a functional reform . Therefore, the transfer of tasks between the highest state authorities (ministries) to the higher state authorities or lower state authorities within a state administration is basically not a functional reform.

In contrast, the term functional reform is also used for cases in which tasks are transferred to lower general state authorities by way of organ lending . This is the case when district administrators and mayors are lower state authorities at the same time and, as such, can perform state tasks. In such a constellation, the district administrators are subject to the full service and technical supervision of the responsible state government with regard to these state tasks.

Functional reform activities are considered administrative reform measures . The main goal is regularly to enable local and citizen-oriented execution of public tasks.

In Brandenburg, the mandate for functional reform is anchored in law. The implementation of the functional reform is subject to state laws that affect a large number of tasks
