Community Board (Austria)

The municipal board is one of the two collective administrative bodies in municipalities in Austria (the other is the municipal council ). It exists on the basis of Article 117, Paragraph 1, Letter b of the  Federal Constitutional Act 1920 (B-VG).

Surname

In municipalities the organ is called the city ​​council , in cities with their own statute the city senate. The municipal code of the respective federal state can also provide for a different name, so the organ in Salzburg is referred to as the municipal authority .

composition

The members of the parish council are elected by the parish council. According to Art. 117 para. 5 B-VG, the system of proportional representation is to be observed, so basically all parties represented in the municipal council have the right to proportional representation on the municipal executive board. The number of members of the parish council is, however, specified by the parish regulations and is generally linked to the number of members of the parish council. In Upper Austria , for example, the number is between three and nine members, depending on the size of the municipal council. This can mean that a local council faction is too small to have a mathematical claim to a seat on the local council.

Usually the mayor and the deputy mayor are members of the community council. The mayor chairs the community council.

tasks

The precise tasks and rights of the municipality board are defined by the municipal code of the respective federal state. Usually the municipality board is responsible for the preliminary consultation of matters that fall within the competence of the municipality council. In addition, a catalog of further tasks has been assigned to the municipality board for each state municipality. Additional decision-making powers can be delegated to the community board by the community council in individual cases.

In statutory cities in particular (they also function as a district administrative authority according to the constitution ), the tasks of the municipal board , the city senate, are usually more extensive. In this way, agendas can be divided between individual members by means of departmental responsibility . B. is the case with the Vienna City Senate .
