Court Organization (Scotland)

The judicial organization in Scotland encompasses ordinary criminal and civil law jurisdiction. The basis of Scottish civil jurisdiction are the Sheriff Courts , comparable to the German local courts . For simple cases of criminal law there is also the Justice of the Peace Courts . The College of Justice comprises the Supreme Courts of Scotland . The organs of the Scottish Supreme Courts are the Court of Session , the High Court of Justiciary , the Office of the Accountant of Court and the Auditor of the Court of Session . The seat of the College of Justice is in Parliament House in Edinburgh . The Scottish Chief Justice is the Lord President of the Court of Session and Lord Justice General , since 2015 Colin Sutherland, Lord Carloway . He is represented by the Lord Justice Clerk , since 2016 Leeona Dorrian, Lady Dorrian .

The judges are appointed by the British monarch on the recommendation of the First Minister , who in turn submits them on the basis of recommendations from the Judicial Appointments Board for Scotland . The term of office of judge ends at the retirement age of 75 years.

The Lord Advocate is the Attorney General of Scotland. All charges are nominally made on his behalf. The incumbent is one of Scotland's Great Officers of State . The current Lord Advocate has been James Wolffe since 2016 . Lawyers are admitted as advocates and solicitors , depending on their training . Some courts, especially the Supreme Court of the United Kingdom , but also the labor courts ( "employment tribunals") have United in civil matters jurisdiction throughout the Kingdom. The High Court of Justiciary remains the highest criminal court in Scotland.
