The law for the provisional regulation of the law of the chambers of industry and commerce is a German federal law and regulates the competence, organization and membership in a chamber of industry and commerce . Accordingly, an IHK is a corporation under public law . Most of the federal states have passed additional state laws.

The IHK has (§ 1) the statutory task of "looking after the overall interests of the [...] traders in their district". It is up to them u. a. especially "to work for the maintenance of the decency and customs of the honorable businessman". She has the right to issue certificates of origin as well as carnets and is significantly involved in vocational training .

Organs of the IHK are the general assembly, the president and the general manager, the latter are elected by the general assembly.

history

Historically, the law of the chambers of commerce and later of the chambers of industry and commerce is state law . For example, the law regulated the chambers of commerce regarding the chambers of commerce in the Grand Duchy of Hesse . In the time of National Socialism , the self-administration of the economy was abolished and the IHKs were finally replaced by regional economic chambers. After the Second World War , the IHK was re-established by ordinances of the military governments. As a result, national regulations were again made. The Basic Law for the Federal Republic of Germany regulated in Art. 74 (1) Item 11 of the Basic Law that “the law of the economy” became a subject area of competing legislation . In 1956, the Bundestag exercised its legislative right and with the law for the provisional regulation of the law of the chambers of industry and commerce passed a federal regulation and thus for the first time a nationwide uniform law of the chambers of industry and commerce.
