Land acquisition
Acquisition of real estate is the contract for the sale of real estate or the right to land , which is to be certified by a notary . The transfer of ownership takes place through the entry in the land register .
General
In common parlance, the acquisition of land is the purchase of a piece of land. In public law is specifically to the road construction associated obligation of the road above authority , private property in land for the purpose of expansion or construction to acquire traffic routes.
When expanding or building new traffic routes
In road and right of way, land acquisition is the purchase of land for the construction of traffic routes (e.g. Section 6 (1a) of the Federal Trunk Road Act or corresponding state law, e.g. Section 10 (2) of the Baden-Württemberg Road Act). When a new traffic route is built or expanded, it may be necessary to acquire additional land for road construction . The need for land acquisition is determined in the building planning (also with the help of the so-called land acquisition plan ) and assessed in monetary terms. Negotiations with the property owners then take place . This will get one for the purchase of the land compensation . If the mutual agreement fails, expropriation proceedings can be applied for under certain conditions .
