Land owner declaration

The property owner's declaration (GEE) is a term from telecommunications and describes a declaration with which a property owner gives consent for the free or chargeable connection of his building to a telecommunications network ( copper pair , coaxial cable , fiber optic network ) via a subscriber line .

The owner agrees with a GEE to have all the devices installed on his / her property and on and in the buildings located on it that are necessary for access to the telecommunications network on the property in question and in the buildings located on it to set up, test and maintain. The owner also agrees that the necessary construction work may be carried out on the buildings. By signing a property owner's declaration, however, the owner does not acquire any entitlement to the subsequent relocation.

In Section 10 of the Telecommunications Customer Protection Ordinance (TKV) (property owner declaration) within the framework of the Telecommunications Act (TKG) in Section 45a TKG (use of land) and Section 76 TKG (impairment of land and buildings), the legislator had the legal basis in the form of the property owner declaration and the Corresponding counter-declaration of the respective network operator created. The text of the property owner's declaration and the counter-declaration have been laid down in a model by the legislature. The TKV was repealed in February 2007 and integrated into the TKG; the GEE is now called a license agreement . Whether text changes (additions, deletions) to the sample (annex to § 45a TKG) are permissible is controversial with regard to § 47b TKG and has not yet been clarified by a judge.
