A farm shop is a business that is directly connected to a farm and in which products from the farm are sold. The term “ ex-farm” sales is also common.

Often purchased goods are also offered in farm shops . There are farm shops that have a limited range of goods and others that sell many products , depending on the concept. Since “farm shop” is not a protected term, it happens that shops that have no connection to an agricultural operation and only sell purchased goods also refer to themselves as such. In order to clearly distinguish the farm shops of the agricultural direct marketers from other shops (supermarkets, bakeries, butchers, delicatessen and natural food stores), the nationwide brand “Shopping on the farm” was created in 1989 by the sponsoring association of the same name and registered with the German Patent and Trademark Office .

In terms of the trade regulations

Whether direct marketing in the farm shop has to be reported as a trade within the meaning of the trade regulations (Germany) depends on the proportion of self-produced products offered, the degree of processing , the location and the turnover of the farm shop. The marketing of self-made agricultural natural products, e.g. B. Milk, eggs, wool or honey from the farm can be assigned to primary agricultural production and does not constitute a trade in the sense of the trade regulations.

A slight expansion to include third-party products does not automatically lead to the acceptance of a trade. The demarcation between agricultural and commercial activity is often controversial in practice due to the lack of a definition in commercial law. When assessing individual cases, the trade offices are guided by the corresponding administrative guidelines and the numerous court judgments, from which further delimitations can be found. In general, revenues that make up less than 10 percent of the total sales of the direct marketing company are considered insignificant.

Marketing of processed and refined products beyond the first processing stage is generally no longer viewed as primary agricultural production.

If the sales of a farm shop with purchased goods consistently exceed a third of the total sales or € 51,500, this is assessed as an independent business enterprise.

Shop closing regulations

The mere agricultural sale from the barn or from the yard without special sales equipment is possible without observing the shop closing times. This also applies if the sale of fruit, asparagus, other vegetables and potatoes is only temporary from the farm or on the roadside, for example during the harvest season. Since a farm shop usually has a fixed, equipped room, it is tied to the regular shop opening hours. The regulation of the shop opening times in Germany lies with the federal states.
