Youth Welfare Parents Advisory Board

The Youth Welfare Parents Advisory Board (JAEB) is a committee that can be elected by parents of children in kindergartens at city and state level in accordance with Section 9 of the Child Education Act of the State of North Rhine-Westphalia in the version valid since August 1, 2011. Since October 10, 2011, elections have been taking place nationwide in all municipalities in North Rhine-Westphalia at the institution and municipal level.

Legal framework

The child education law of the state of North Rhine-Westphalia provides for the first time an elected parent representation at city and state level. Up until now, the election of parent representatives was only provided for at kindergarten level.

Section 9b of the Act regulates the framework conditions. The law provides that the parents' councils in the day-care centers are to be elected by October 10 of each year. In a period from October 11th to November 10th of each year, the assembly of parents 'councils can elect the youth welfare office parents' council at city level. Up to November 30th of each year, the youth welfare parental councils can be formed at the state level to elect the state parent council from among their ranks.

The law prescribes a quorum of 15% of the parents' councils in the respective youth welfare office district, a multi-stage election process and a very tight time frame for the validity of the election .

The law obliges the youth welfare offices to support the election. What exactly the youth welfare offices should do is not regulated. It is also not regulated who should check the required quorum and how that should be done. The law also leaves open, among other things, which rights can be derived from parent representation in the Youth Welfare Parents' Council. The Implementation Act (Fifth Act for the Implementation of the Child and Youth Welfare Act ) stipulates that the Youth Welfare Parents' Advisory Board can send an advisory member to the child and youth welfare committee of the municipality in accordance with Section 5 (1) No. 9 AG-KJHG .

Interpretation of law

The gaps in the law and the urgent need for action by the youth welfare offices have led to a short-term interpretation of the law by representatives of the North Rhine-Westphalia City Council . It clarifies that parents say no parents to co-determination means. However, the interpretations of the law in the so-called work aid are controversial.

Criticism of the law

The Child Education Act introduces a right to vote in Section 9, which is regulated by a 15% quorum , a tight schedule and a multi-stage election process. This is unique in the area of ​​volunteering and has already been sharply criticized by parents' representatives.

State parents' advisory board for day-care centers in North Rhine-Westphalia

The State Parents' Council represents the interests of around 500,000 children and their parents in North Rhine-Westphalia. The LEB NRW was selected in 2011 for the first time in 40 years of daycare history on the basis of the Children's Education Act (KiBiz) §9. Since then, there has been elected parenting in NRW from daycare through the municipal level (youth welfare parental councils) to the state level. In 2012, youth welfare councils were elected in 167 youth welfare districts out of 185 throughout North Rhine-Westphalia, 111 of which elected the state parents advisory council.

Youth Welfare Parents 'Council and City Parents' Council

Before the statutory regulation of parents' representation at city and state level, voluntary city parents' councils had been formed in the years before , including the city parents' councils in Dortmund, Düsseldorf, Essen, Cologne and Münster. In contrast to the Youth Welfare Parents ' Advisory Council, the existing city parents' councils are usually organized as an association and are based on the initiative of committed parents. How the relationship between the two interest groups will develop in the future is currently open. Parents doubt that the highly regulated structure of the Youth Welfare Parents' Advisory Board can be permanently filled with life. On the other hand, the elections for the Youth Welfare Parents 'Advisory Board were partly carried out by the city parents' councils themselves, for example in Cologne .

Wording of voting rules

In detail, the law provides the following provision for the youth welfare office parents' council at city level:

“The meeting of parents' councils elects a youth welfare parent council between October 11th and November 10th. The validity of the election of the Youth Welfare Parents Advisory Council presupposes that 15% of all parents advisory councils in the youth welfare office district have participated in the election. The Youth Welfare Office is to give the Youth Welfare Parents' Advisory Board the opportunity to participate in essential questions relating to day-care centers. "
