Kuala Lumpur War Crimes Commission

The Kuala Lumpur War Crimes Commission or short KLWCC (German: Kuala Lumpur -Kriegsverbrecherkommission ) was an especially active until 2013 Malaysian organization and was in the year 2007 by Mahathir Mohamad has been launched. Mahathir Mohamad explained the establishment of the KLWCC as an alternative to the International Criminal Court in The Hague , which he attributed to a bias in the selection of proceedings.

Judgments on appeal to universal jurisdiction

In November 2011, citing universal jurisdiction in absentia, the court found former US President George W. Bush and former British Prime Minister Tony Blair guilty of crimes against peace on the grounds of the unlawful invasion of Iraq. The declared reason for war was the existence of weapons of mass destruction , none of which were found.

In May 2012, after hearing testimony from victims of torture from Abu Ghraib and Guantanamo , the arbitration tribunal unanimously approved former US President Bush, former Vice President Dick Cheney , former Defense Secretary Donald Rumsfeld , former Assistant Attorney General John Yoo and Jay Bybee , the former Attorney General Alberto Gonzales and former advisers David Addington and William Haynes II found guilty in the absence of conspiracy to commit war crimes, including torture . The court brought its findings to the Chief Prosecutor of the International Court of Justice in The Hague.

After this "verdict" there was no evidence of any activity, even if conspiracy theorist Michel Chossudovsky and others hoped to reactivate the organization to condemn Israel.

Legitimacy of the tribunal

Former UN special rapporteur on the independence of judges and lawyers, Param Cumaraswamy , said the court was a private company with no legal basis and questioned its legitimacy . The court has no UN mandate or recognition, no power to order arrests or to impose a sentence, and it is not apparent that its judgments are other than symbolic in nature.

A statement by the Tribunal on its website states: "In the event that this court convicts any of the accused, the only sanction is that the guilty person's name be entered in the Commission's war crimes register and published worldwide."
