State spatial planning program Lower Saxony

The regional spatial planning program (LROP) is the regional planning plan for the state of Lower Saxony . With it, the politically and legally anchored spatial planning for the third largest German area is determined. In the spatial planning program, u. a. defines the importance given to certain forms of use, such as B. conventional agriculture , nature conservation, settlement areas, traffic routes, raw material extraction and others.

With binding statements on space-relevant uses and their developments, the state spatial planning program serves to determine the often conflicting economic, social, cultural and ecological interests in the space.

Legal basis

The state's spatial planning program in its current version (2013) is based on an ordinance from 1994. It has been updated several times since then, fundamentally amended in 2007/2008 and updated in 2011/2012. The current version of the LROP amending regulation has been effective since October 3, 2012. The basis for the establishment and application of the LROP today (2015) are the Regional Planning Act (ROG) of December 22, 2008 (Federal Act) and the Lower Saxony Regional Planning Act (NROG), which are based on ordinances at the federal (e.g. spatial planning ordinance) and state level (e.g. planning regulations ) can be added.

Development since 2013

With the change of government to the Weil cabinet in 2013 , there was also a different land use policy. In April 2013 the state government announced that it would remove all peat extraction areas from the state spatial planning program (LROP). For reasons of climate and nature conservation , priority areas for peat extraction should be dispensed with entirely in future . The participation procedure for the change was initiated in summer 2014, the deadline for submitting comments was the end of 2014. To take account of the comments of those affected, a draft in autumn 2015 provides for the retention of 4,500 hectares of peat land as a compromise. So far, peat cutting has been permitted on 21,300 hectares.

The basis for moor protection in Lower Saxony is to be a current stock analysis of the raised and fens. The aim is to restore soils with high carbon contents to a near-natural state. In this way, their climate and soil protection function should be regained.

In the medium to long term, the state government would like to create a "North German Moorland" moor protection system. For this purpose, the areas are to be compiled and protection goals and uses are to be defined in a cooperative dialogue with the population, farmers and associations. The emergency program 2014/2015 consists primarily of the rounding off of public areas and first concrete measures for rewetting . At the same time, future wetting measures in particular are being planned and the necessary approval procedures initiated. The funding should be based on EU funding ( ERDF , EAFRD , LIFE ). Concrete medium and long-term measures are to be implemented from 2016.

After further participation steps and changes to the draft LROP, the cabinet agreed in April 2016 to submit it to parliament for comment.
