process

After he had work done in his house by carpenters from the community in 1927, he was arrested in March 1930, because he was suspected of misappropriating community funds. Weinhofer then took leave of absence and resigned all of his political functions after his conviction. He lost his mandate in the state parliament on February 22, 1932.

The trial against Weinhhofer and the nine co-defendants was opened on February 8, 1932 at the Regional Court for Criminal Matters Vienna by the public prosecutor Hellriegl, with almost 100 witnesses summoned. Weinhofer was defended by Arnold Eisler . The verdict was announced by Judge Drögsler on February 23, 1932. Weinhofer was convicted because he did not forward two criminal charges - including one against his son Leopold - and granted the community funds as loans. He was sentenced to two months of simple prison, compounded with one fast day per month. He was acquitted of suspicion of embezzlement. The co-defendants in the process received different sentences and also acquittals.
