Withdrawal of the title and different counting
The third Earl took part in the Jacobite revolt of 1715 , whereupon he was ostracized by a parliamentary resolution ( Bill of Attainder ) of November 13, 1715 for high treason , which also involved the revocation of his title. His son and heir, James Ogilvy († 1731), who was also outlawed in 1716, was pardoned in 1725, but the title was not restored. His nephew and heir, David Ogilvy (1725-1803), was ostracized when he took part in the Jacobite revolt of 1745 , and was pardoned in 1783 without the title being restored. His brother and heir Walter Ogilvy of Clova (1733-1819) tried to restore the title, but died before a decision could be made. His son David Ogilvy (1785-1849) finally obtained on May 26, 1826 the retroactive lifting of the ostracism of the third earl and the restoration of the title in his favor. He is usually counted as the 4th Earl. In view of the fact that the retrospective restoration also legitimized the title claim of his predecessors who had since died as title pretenders and de-iure earls, he can - depending on whether their own ostracism and the title claim of David Ogilvy (1751-1812), who is insane due to mental illness, counted as 5th, 6th, 7th, 8th, or 9th earl.
