Replica (seed)

from Wikipedia, the free encyclopedia

Replica is a form of seed production by farmers on their own farm: The seeds produced in this way are called "replicas", and varieties suitable for replicas are called " seed-proof ".

According to § 10a of the Federal German Plant Variety Protection Act , replica is "harvested material that a farmer has obtained by cultivating propagation material (...) on his own farm and used there as propagation material". The reproduction of seeds protected by variety law is permitted (“ farmer's privilege”) if the farmer pays a “reproduction fee” to the owner of the variety right and fulfills certain information obligations towards him. Small farmers are exempt from the obligation to produce replicas.

Restrictions on replica

The topic of "replicating seeds" has been the subject of controversial discussion for years: Organizations that represent the interests of non- industrial agriculture , such as the ABL , regularly speak out against the right of farmers to "freely replicate" what they have already used Restrict varieties. Should there be a large-scale release of genetically modified varieties of crops such as oilseed rape or winter crops come, will, as well as representatives of the legendary German Farmers' Association , a private replica of patent law reasons no longer be possible, thus lead to considerable additional burdens on businesses would.

Reproduction is made more difficult not only by the protection of varieties and patents by fees, but also by genetic mechanisms in plant breeding by the large seed companies : " Hybrid varieties " that are created by crossing inbred lines are not seed-proof, the same hybrid variety can only be obtained by crossing the Inbred lines are generated.

In order to circumvent plant variety protection and patent rights, “free” varieties can be used: Plant seeds and the plants growing from them are referred to as “free varieties” or “free seeds”, which are unconditionally released for any use by everyone in accordance with the efforts of various initiatives are.
