New Mexico Attorney General
The New Mexico Attorney General is one of the constitutional offices of the state of New Mexico . He is in charge of the New Mexico Department of Justice . The office holder must be a licensed attorney. The Attorney General acts as the chief legal officer, legal advisor to the state government, and guardian of the public interest.
In the succession of the New Mexico Governor , the Attorney General is in fifth place, after the Lieutenant Governor , the Secretary of State , the President pro tempore of the New Mexico Senate and the Speaker of New Mexico House of Representatives.
The office was created in 1912 with a five-year term. The incumbent is elected by the eligible population of New Mexico. At the elections in 1916, the term of office was reduced to two years with the possibility of one re-election. The term of office was then extended to four years for the elections in 1970. Re-election was not possible. Another change was made for the 1990 elections. The term of office remained at four years. For this, the possibility of a one-time re-election was granted.
The current New Mexico Attorney General is Hector Balderas , who took up his post on January 1, 2015.
Duties and duties
The Attorney General represents the State of New Mexico before all courts and authorities when the public interest so requires or when the governor of New Mexico has requested it . In addition, the Attorney General will prosecute and defend all cases before the New Mexico Supreme Court , the New Mexico Court of Appeals, or any other court or tribunal in which the state is a party or must defend its interests. The Attorney General will also prosecute and defend all acts and proceedings in which any government employee is involved in his / her official capacity. The Attorney General can also represent any local or small business consumer before the New Mexico Public Regulation Commission .
Upon request, the Attorney General will prepare written statements to the legislature, any civil servant, or any district attorney on any subject that any such officer may require. The Attorney General provides legal assistance to the Secretary of State of New Mexico on matters relating to the State Election Code.
The Attorney General drafts contracts, bonds and other instruments required by the state.
At the direction of the governor, the attorney general may attend and assist in any trial of any indictment or information in any county in the state. If a district attorney fails or refuses to act, the Attorney General may act on behalf of a county in a criminal or civil matter.
In the case of impeachment proceedings against state officials or employees, the Attorney General initiates enforcement requests due to conflicts of interest . The Attorney General also pursues repatriation matters against District Attorneys.
The Attorney General also maintains and maintains a register of all documents filed by charities and makes them available to the public.
