The international trademark classification (also known as the Nice classification ) is an international agreement on the classification of goods and services for the registration of a trademark . It is administered by WIPO and used in more than 140 countries worldwide.

Goal setting

With the brand classification, the claimed areas ( classes ) of the goods or services are determined for which a name, word, image, symbol, etc. can be protected. It consists of 45 classes.

It is possible that different applicants can register the same word mark (e.g. Tempo ) as long as this is done in different classes. It should be noted, however, that different classes can contain similar goods or services, so that an entry would infringe older rights (e.g. software in class 09 and programmer services in class 42).

history

The trademark classification was agreed on June 15, 1957 in Nice with the Nice Agreement on the international classification of goods and services for the registration of trademarks internationally and is therefore also called the Nice Classification .

Since then it has been reissued every five years in a revised version. In order to be able to keep pace with social and technical developments, annual "versions" have also been published since 2013, which can include new terms or deletions of existing terms. Major structural changes (e.g. class changes, creation of new classes, deletion of existing classes) are still reserved for the "editions" that appear every five years. On January 1, 2017, the 11th edition of the International Trademark Classification came into force; since January 1st, 2019 the "Version 2019" of the 11th edition applies.

Classification

The classification of the classes according to § 19 paragraph 1 of the Trademark Ordinance of the 9th edition of the Nice Agreement was changed in the 10th edition. The previously applicable classification rules have been completely revised, new terms have been introduced or deleted and assignments to the individual classes have been changed.
