Otto Gumpinger

Otto Gumpinger (born April 24, 1956 in Sankt Willibald ) is a former Austrian politician ( ÖVP ) and entrepreneur.

education

Otto Gumpinger completed basic technical training in electrical engineering at HTBLA II (today LiTEC ). This was followed by a degree in social sciences at the University of Linz , from which he graduated with a master's degree. He did his basic military service with the Upper Austria Military Music.

Political activity

His political career began in 1977 with the Junge ÖVP Upper Austria. From 1985 to 1986 he was a member of the Linz municipal council .

From 1985 to 2007 he was a member of the state parliament in Upper Austria . He was also president of the Upper Austrian Family Association and of "Eine Welt - Oberösterreichische Landlerhilfe".

Otto Gumpinger is an advocate of "equal voting rights for all citizens from birth". Children who are not yet entitled to vote should have the right to vote in elections, which can then be exercised by their parents as a representative.

Tug affair

After a criminal complaint regarding people smuggling and embezzlement was brought against him , he suspended his state parliament mandate in June 2007. His political immunity was lifted in autumn 2006 by the Upper Austrian state parliament at his suggestion. He was charged with helping 27 Moldovans to illegally enter the Schengen area . He is said to have received 450 euros per towed person and embezzled more than 17,000 euros. Gumpinger denied all allegations with the argument that his organization only supports touristic group trips by Eastern Europeans to Western Europe, that he was deceived and abused. On September 11th, 2007 he was found guilty of smuggling with conditional intent and embezzlement at the Linz Regional Court and sentenced to 2 years of unconditional imprisonment. Gumpinger appealed. On September 13, 2007, the ÖVP Landtag Club applied to the State Audit Office for an audit of all associations that were headed by Otto Gumpinger. In the appeal hearing on June 16, 2008, the case was returned to the first instance and the first judgment overturned. In the hearing on September 9, 2011 at the Linz Regional Court, the public prosecutor's office approved the reading of the written testimony of the 9 Moldovan witnesses, who massively exonerated Gumpinger, and no further legal assistance was requested from the Republic of Moldova.

In a parallel proceeding against a Linz lawyer and an interpreter, who both also exonerated Gumpinger, an acquittal by the Linz Regional Court has already taken place. The public prosecutor's office in Linz appealed against this, but the acquittal was confirmed. On October 14, 2011, after more than four years of proceedings, a first-instance judgment was issued in the second legal process: Gumpinger was sentenced to 14 months in prison, of which four months were unconditional. The judgment was served on Gumpinger in February 2012 and was opposed by him. After a new appeal, Gumpinger was sentenced on November 26, 2012 by a judge's senate at the Linz Higher Regional Court to 16 months of unconditional imprisonment for smuggling and embezzlement. The judges' senate justified the strict judgment with the general prevention , which excludes a conditional forbearance.

Gumpinger is the managing partner and 33% owner of MSV Multicall GmbH, based in Linz.

The "Federal Association of the Transylvanian Saxons in Austria" awarded Gumpinger the Golden Decoration.

Otto Gumpinger is married and has three children.
