Framework collective agreement

A framework collective agreement was a superordinate collective agreement in the GDR between trade unions and the company or state management, which was directly applicable and was the basis for subordinate collective agreements (e.g. company collective agreements ) or agreements. In the West German labor law , there was no framework collective agreements.

Tariff partner

In the labor law of the GDR , which had no collective bargaining autonomy , the RKV was used to regulate the wage and employment relationships in the individual economic sectors on the basis of the legally anchored national economic plans and other general legal provisions. RKVs were mostly concluded between specialist ministries, associations of state-owned companies (VVB) or combinates on the one hand and the individual unions of the Free German Trade Union Federation (FDGB) on the other. In addition, RKV came about between central cooperative management bodies and the councils of the districts on the one hand and the FDGB federal board and the district boards on the other, in order to regulate the wage and working conditions for cooperative institutions and the district-run state-owned economy.

In any case, the RKV had to be registered with the State Committee or State Secretariat for Labor and Wages before they came into force

For private companies, on the other hand, especially in the handicrafts and small businesses, the agreements with the traditional term " collective agreement " were concluded between the chambers of crafts or the chambers of industry and commerce on the one hand and the individual unions of the FDGB on the other .

According to the Labor Code (GBA) of 1961 and the Labor Code of the GDR (AGB) of 1977, the RKV mainly had to include more detailed provisions on wages, working hours and vacation leave. Since the national economic plans (e.g. in the respective seven- or five-year plan ) already contained specific guidelines for the development of wage policy and the State Committee for Work and Wages or the resulting State Secretariat for Work and Wages with the BuV already established corresponding classification principles in advance the industries agreed, there was little room for maneuver when the RKV was concluded.

Wage disputes

There was no regulated procedure for resolving differences of opinion between the two contracting parties. Rather, they saw each other i. d. R. causes disagreements, if they existed, to be put on hold in order to jointly achieve the most favorable conditions possible for “their” branch or “their” combine vis-à-vis the State Planning Commission.

Austria

A framework collective agreement mostly applies to branches of the economy that consist of several branches that are similar to one another. In such collective agreements, a basic standard is agreed that is the same for all industries. Additional collective agreements can then be used to conclude specific regulations for individual industries.

By combining the industries in negotiations, the negotiating position of the employees is usually strengthened. At the same time, however, the negotiations become more difficult and time-consuming, as different group interests have to be united.

  • Framework collective agreement for employees in industry, which is concluded between GPA-djp and the Federal Industry Section of the WKÖ.
  • Framework collective agreement for employees in the Austrian mineral oil industry in the current version of February 1, 2019. This collective agreement is concluded between the Association of the Austrian Mineral Oil Industry on the one hand and the Austrian Federation of Trade Unions, the Union of Private Employees, Printing, Journalism, Paper and the PRO-GE trade union on the other.

  • Framework collective agreement for employees in industry in the version applicable to employees of large bakers (formerly bread industry) with salary regulations and additional collective agreements AS OF OCTOBER 1, 2016 (NOVEMBER 1, 2016). The collective agreement is agreed between the Industry Section of the Federal Chamber of Commerce, on the one hand, and the Austrian Confederation of Trade Unions, Union of Private Employees, Industry and Commerce Section, on the other.

As an equivalent in Anglo-Saxon countries, the collective agreement between the labor market parties can be seen, although it is based on a completely different legal tradition.
