The Directive 2013/33 / EU of the European Parliament and of the Council of June 26, 2013 on the establishment of standards for the reception of persons who apply for international protection (new version), also known as the Reception Directive, introduces common standards within the framework of the Common European Asylum System the named group of people.

Council Directive 2003/9 / EC of January 27, 2003 on minimum standards for the reception of asylum seekers, also known as the Asylum Reception Directive or, for short, the Reception Directive, laid down minimum standards for the reception and care of asylum seekers .

In 2013, the European Commission presented a draft of a revised version of the Asylum Reception Directive.

In Article 8, the new draft explicitly adhered to the principle that no one may be detained for the sole reason that they are seeking international protection, in accordance with the principle already laid down in Article 18 of the Asylum Procedures Directive . Compared to the previous version, however, it provided more and more extensive grounds for detention for asylum seekers and provided the basis for detention without a criminal reason. Even minors should be detained; Unaccompanied minor refugees, on the other hand, are to be accommodated in youth welfare facilities.
