The Directive 93/83 / EEC on the coordination of certain rules concerning copyright and rights related to satellite broadcasting and cable retransmission , known as Satellite and Cable Directive or SatCab directive was from the Council of the European Union decided on 27 September 1,993th
The aim of the directive is to harmonize national copyright law with regard to cross-border broadcasts via cable or satellite . This is intended to achieve the freedom to provide services guaranteed in the EC Treaty within the common internal market of the EU member states for cross-border broadcasting.
The guideline establishes framework conditions that should make it easier for satellite and cable network operators to acquire the necessary rights to broadcasts. For this, the directive standardizes the transmission principle of the country and certain limitations of the principle of freedom of contract, the clarification of copyright and neighboring rights simplify and to secure the remuneration of right holders.
The member states had to transpose the provisions of this directive into national law by January 1, 1995. The German legislature decided to create uniform rules not only for cross-border television, but also for programs that can only be received in Germany.
In July 2002 the Commission reported on the implementation of the Directive in the Member States.
The satellite and cable directive was modernized with the directive (EU) 2019/789 (online SatCab directive) in the course of the EU copyright form also for web offers ( digital single market ).
