Siegauen rape

The Siegau rape is a criminal case that occurred in Bonn's Siegaue in 2017 .

Sequence of events

On the night of April 2, 2017, the perpetrator cut open the tent of a young couple from southern Germany. He threatened the two with a pruning saw and initially demanded that valuables be returned. He then forced the woman out of the tent with him. While the 23-year-old was raped on a blanket in front of the tent , her 26-year-old friend informed the police in the tent .

Manhunt

The police searched for the perpetrator for several days, including with a phantom image and photos of objects assigned to him. The man was recognized and arrested a week later on the banks of the Rhine in Bonn-Beuel .

Perpetrator

The perpetrator was a 31-year-old rejected asylum seeker from Ghana who, according to media reports, had committed a crime in the past. In his homeland he is said to have killed his brother-in-law a few years ago in an inheritance dispute. The fear of his family's revenge is said to have been the reason why the man fled his homeland.

At the beginning of 2017, the perpetrator first traveled to Italy , where the authorities forbade him to stay. He then entered Germany illegally, where he was arrested on February 9, 2017 in Kassel and then quartered in the central accommodation facility of the state of North Rhine-Westphalia in Sankt Augustin . Since Ghana is considered a safe country of origin , the Federal Office for Migration and Refugees rejected his asylum application on March 23, 2017. Until his arrest on April 9th, he lived in a refugee shelter in Sankt Augustin.

While in custody, the perpetrator repeatedly attracted attention through excessive violence. Among other things, he set fire to his prison cell in the correctional facility in Cologne-Ossendorf . When two members of staff at the facility tried to put out the fire, he attacked the two guards, injuring one of them in the head. During the transport to the institution, the perpetrator had already attacked a member of staff while getting out of the car.

According to forensic examination, there is significant personality disorder , particularly narcissism . Since the public prosecutor's office assumed that the perpetrator was guilty, the perpetrator had to appear before the Bonn district court for rape and extortion by predators from the end of September 2017. A DNA report convicting him referred, among other things, to traces of semen in the intimate area of ​​the injured party, but did not induce the perpetrator to abandon his strategy of pleading innocence. Since shame and remorse cannot be recognized, the forensic examination sees a high risk of relapse.

Criticism of the police

After the contents of the emergency call made by the raped woman's friend became public, the media began to criticize the police's behavior from the end of May. The boyfriend had said on the phone: “Hello, my girlfriend is being raped. From a black man. He's got a machete. ”The officer at the other end of the line had replied:“ You don't want to be kidding me, are you? ”. After the alert of a patrol car had been assured, the officer hung up with the words "Thank you, bye" instead of holding him on the line. After initially no help had arrived, the friend dialed the emergency number again, whereupon a control center officer referred to colleagues from another department.

At the beginning of June 2017 it became known that the two employees would have to leave their previous posts as a result of these events. The Bonn police had previously admitted that the "receiving officer did not properly classify the circumstances of the first call and responded inappropriately linguistically".

Trial and Detention

The trial against the perpetrator at the Bonn Regional Court began in September 2017 with national media interest . Contrary to the advice of his lawyer, the defendant made personal statements about the crime and denied it.

A psychiatric report found that the defendant had narcissistic personality traits, but they were not pathological. He was thus fully responsible . The court sentenced him to eleven and a half years in prison in October 2017, falling below the prosecution's request, which had asked for 13 years. The defense appealed against the judgment.

In February 2018, the perpetrator was seriously injured in a fire in his cell, which he allegedly set himself.

Due to the revision of the accused, the Federal Court of Justice (BGH) confirmed the conviction of the Bonn Regional Court on April 11, 2018, but revoked the associated prison sentence. The regional court did not determine the absolute culpability of the perpetrator free of legal errors. Another criminal chamber of the Bonn Regional Court had to re-examine a possible reduced culpability and determine the sentence. The new judgment of the criminal chamber of October 4, 2018 set a prison sentence of ten years. The justification of the court for the punishment was that Eric X. had never appeared in crime before. The defendant's attorney has announced that he will challenge the verdict because it does not appear to be "watertight".
