Soviet zone refugee

Soviet zone refugee is a term used for people who, after fleeing the Soviet zone of occupation and the GDR, took up residence within the scope of the Basic Law or West Berlin .

According to the legal definition in § 3 of the Federal Expellees Act (BVFG) of 1953, a refugee from the Soviet zone is a German citizen or ethnic German who had or had had his residence in the Soviet occupation zone or in the Soviet-occupied sector of Berlin , and had to flee from there in order to be one of to evade him or her from a particular predicament caused by the political situation, and there has not violated the principles of humanity or the rule of law through his behavior .

A particular predicament existed above all when there was an immediate danger to life and limb or personal freedom. Economic reasons alone did not justify recognition as a refugee from the Soviet Zone.

According to Section 4 BVFG, a German citizen or ethnic German who at the time of the occupation was resident in the Soviet-occupied zone or the Soviet-occupied sector of Berlin and was outside these areas, but could not return there, was treated as a Soviet zone refugee to be exposed to an immediate danger to life and limb or personal freedom for which he is not responsible.

Those who fled the Soviet zone received a C refugee ID within the scope of the BVFG .

GDR contribution periods for former GDR citizens who moved to the Federal Republic of Germany on May 18, 1990 are calculated for insured persons born in 1937 or later according to Book Six of the Social Code (SGB VI) and not according to the Foreign Pension Act .
