Social Security (Equatorial Guinea)

The social insurance in Equatorial Guinea is a liability insurance which is centrally responsible for all services in the country benefits, including primary health care, retirement.

Legal basis

A first law on maternity protection and invalidity was passed in 1947. As early as 1965 (Law 91 of November 21) a pension fund called the Caja des Securos Sociales de Guinea had been created to pay compensation for the consequences of an accident at work.

The Reglamento del Régimen General de la Seguridad Social (Decreto núm. 100/1990) fully implemented the Social Code of 1984 (Decreto núm. 104/1984). In addition to the sections on scope, funding, administration and Community regulations, it contains regulations on the following areas:

  2. Sick pay
  3. Maternity allowance
  4. Benefits disability
  5. Retirement pension
  6. Benefits in the event of death and to survivors
  7. Osh
  8. Money for families
  9. social services

administration

Control lies with the Ministry of Labor and Social Affairs ( Ministerio de Trabajo y Seguridad Social ). The executive body is the Instituto des Seguridad Social (INSESO), created in 1984 , which operates the following branch offices (V) and (poli-) clinics (M):

  • on Annobón in Palé (V)
  • on Bioko in Luba (V) and Malabo (V, M)
  • on the mainland ( Rio Muni ) in Bata (V, M), Ebebiyin (V, M), Mongomo (V, M) and Evinayong (V)

financing

The Equatorial Guinean social insurance is financed by contributions and co-payments from employees and companies. Employees pay 4.5% of their earnings, companies 21.5% of their wages. Surpluses are invested with interest. A quarter of the expenditure is borne by the state treasury.

Insured

All employees in the private and public sectors are compulsory members; this includes clerics and soldiers . Their family members and others, especially students , self-employed and cooperative members, are also included . Registration takes place through the company; the insured person receives an ID ( Carnet de Asegurado ). There are additional benefits for family members who are also provided for, which are calculated according to a point system.

Services

The following services are provided by INSEO:

  • Medical-pharmaceutical: 75% of the costs in state clinics in the event of illness. Treatment of the consequences of an accident at work is free. Medicines are free of charge during a hospital stay; in the case of outpatient treatment, a share of 50% may be required. For normal prescriptions, the deductible is also half. Costs for private treatments can be reimbursed on request according to the above rates.
  • Sick pay: Employees who have been with the company for 12 months receive half of their wages in the event of incapacity for work - up to 26 weeks (can be extended by a medical officer). There is no waiting period for accidents at work.
  • Maternity allowance: Mothers who have been employed for at least 12 months receive 75% of their basic wage for 84 days (six weeks each before and after birth).
  • Disability or occupational disability: Insured persons who have been registered for at least five years receive a pension of 40 to 80% of their basic wage, depending on the extent of the disability. The rates are higher (up to 100%) if the damage is due to an occupational accident. The duration of benefits for minor or temporary disabilities can be limited to 6–48 months.

Unemployment benefits are not paid.

Pensions

An old-age pension, the receipt of which excludes further social benefits, is available for insured persons over 60 who have paid contributions for at least 120 months. The pension amount is at least 40% of the average income of the last 24 months and increases by two percentage points for each year of contribution payment beyond 10 years, up to an upper limit of 80%. Pension adjustments are planned every five years.

Widows and orphans, possibly also parents in need (80%) of the deceased receive a pension, which may be limited in time and which is determined analogous to the provisions on disability (minimum insurance period 60 months). The spouse of a deceased pensioner receives 80% of his or her pension, the partner (or relatives) cared for by the deceased receive 40% for two years. Widow's pensions are discontinued when they remarry. Orphan's pensions are paid for children under 14 when they are in school.
