Stability Council

Stability is the name of a committee of federal and countries in Germany . The Stability Council oversees the budget management of the federal and state governments. It was set up in 2010 and succeeded the previous Financial Planning Council.

The legal basis is the law on the establishment of a Stability Council and the Avoidance of Budgetary Emergencies (Stability Council Act, StabiRatG) of 10 August 2009, which was promulgated as Article 1 of the Act accompanying the second reform of federalism (Federal Law Gazette I p. 2702).

The corresponding laws were passed by the Bundestag on May 29, 2009 and by the Bundesrat on June 12, 2009.

The state parliament of Schleswig-Holstein announced in May 2009 that it would take legal action against the laws and thus indirectly against the introduction of the Stability Council before the Federal Constitutional Court and submitted it in February 2010. Remarkably, the lawsuit was filed although the government changed between the announcement and the filing of the lawsuit: the grand coalition (see Cabinet Carstensen I ) collapsed in July 2009; a CDU / FDP government followed ( Cabinet Carstensen II ). The lawsuit was declared inadmissible on August 19, 2011.

With the law amending the Basic Law (Articles 91c, 91d, 104b, 109, 109a, 115, 143d), Article 109a was inserted into the Basic Law, on the basis of which the Stability Council Act was passed.

According to the Stability Council Act, the financial situation of the federal and state governments is presented and checked annually. In the event of impending budget emergencies , the Stability Council should agree on restructuring programs . The decisions of the Stability Council are published.

The Stability Council was constituted on April 28, 2010. At the same time, it adopted rules of procedure and established indicators and thresholds for regular budget monitoring and the methodological procedure for projecting medium-term budget developments.

According to Section 6 of the Stability Council Act, the Stability Council is also responsible for compliance with European budget discipline requirements. It ensures that the general government structural balance (i.e. the aggregated structural balance of the federal, state, local and social security budgets) does not exceed the upper limit of 0.5% of gross domestic product set out in Section 51 (2) of the Budget Principles Act. The Stability Council is supported by an independent advisory board in accordance with Section 7 of the Stability Council Act .

In its 2nd meeting on October 15, 2010, the Stability Council formally stated that there were signs of an impending budget emergency in the states of Berlin, Bremen, Saarland and Schleswig-Holstein . The Stability Council set up an evaluation committee for further examination. On May 23, 2011, these four federal states were placed under supervision by the Stability Council due to impending budgetary emergency. In its fourth meeting on December 1, 2011, the Stability Council agreed with the states of Berlin, Bremen, Saarland and Schleswig-Holstein restructuring programs for the years 2012 to 2016.

In the subsequent meetings 5–7, the Stability Council took note of the restructuring reports from the states of Berlin, Bremen, Saarland and Schleswig-Holstein and pointed out that the consolidation course was being consistently followed.

At its eighth meeting on December 5, 2013, the states of Berlin, Bremen, Saarland and Schleswig-Holstein presented their renovation reports. While Berlin and Schleswig-Holstein are continuing their previous consolidation course, the successful completion of the agreed restructuring program in Bremen is at risk.
