Foundation supervision (Liechtenstein)

The foundation supervision is in the Principality of Liechtenstein since 1 February 2013 by the Office of Justice perceived as a foundation supervisory authority (STIFA).

All charitable foundations are subject to the Liechtenstein foundation supervisory authority. Private-benefit foundations only if they have submitted to the Liechtenstein foundation supervisory authority in the foundation deed. At the end of 2016, 1,323 non-profit foundations, four non-profit institutions and 19 private-benefit foundations were subject to this supervision (of around 15,000, see also: Liechtenstein Foundation ).

Duties of the foundation supervisory authority

The foundation supervisory authority decides on the need for supervisory measures on the basis of the auditors' reports . Auditors are to be appointed by all registered foundations.

The primary goal of foundation supervision is the protection of the foundation's assets.

The foundation supervisory authority must apply to the judge ( Princely Court of Justice ) to order specific measures within the framework of foundation supervision in non-dispute proceedings .

The duties of the foundation supervisory authority in Liechtenstein (2017) are carried out by a full-time department head (100%), a deputy department head (50%) and a legal employee (50%).

  1. The land and public register office was previously responsible from April 1, 2009 (amendment of the foundation law by LGBl. 220/2008) until January 31, 2013. This has now been transferred to the Office of Justice .
