The Tribunal Superior Eleitoral (TSE), German: the Supreme Electoral Court or the Supreme Electoral Court , is the supreme body of Brazilian electoral jurisdiction .

history

The basis for today's TSE was created with the Decree No. 21.076 of December 31, 1932, which became known as Código Eleitoral de 1932 , after Getúlio Vargas came to power. It was suspended again with the coup and the 1937 constitution. Hermenegildo de Barros was the first president from May 20, 1932 to November 10, 1937 . It was not until 1945, with the democratization processes under President José Linhares , that there was a revitalization. Linhares himself chaired the TSE before and after his presidency. Decree No. 7.586 of May 28, 1945, known as Código Eleitoral de 1945 , was incorporated into the Brazilian Constitution of 1946 (Article 94, VI). The organization into a Supreme Electoral Court and regional electoral courts for the states and the federal district is in the Brazilian Constitution of 1967 (Article 107, IV, 123 to 132), the Constitutional Amendment of 1969 (Article 112, V, 130 to 140) and in the Brazilian Constitution of 1988 (Articles 92, V, 118 to 121) has been preserved and supplemented by other laws on the right to vote. In 2015, the TSE could look back on a 70-year history.

In 2011 the TSE moved into the new building designed by Oscar Niemeyer in the capital Brasília .

Tasks, responsibilities

The TSE is part of a system of supreme jurisdiction that also includes the Supremo Tribunal Federal (STF), Superior Tribunal de Justiça (STJ), Superior Tribunal Militar (STM) and the Tribunal Superior do Trabalho (TST). It is autonomous without the possibility of appeal , but decisions that are directed against the constitution can be appealed to the Supreme Federal Court. Together with the regional electoral courts, it is responsible for all electoral matters: registration and admission of parties to elections, registration of voters, counting of votes and control of election crimes. Electronic ballot boxes were introduced and, for the first time in 2018, voting eligibility was checked using biometric identification procedures .

composition

The TSE is made up of seven, previously eight, judges who hold the title of minister. Three are elected by secret ballot from the judges of the Supreme Federal Court (STF), two from the judges of the Supreme Court (STJ), and two more are appointed by the President of the Republic from six judges proposed by the STF.
