Urząd Ochrony Konkurencji i Konsumentów ( UOKiK ; German  Office for Competition and Consumer Protection , Office for Competition and Consumer Protection ) is the Polish competition authority serving the President of the Office for Competition and Consumer Protection, a central body of the Polish state apparatus (the government administration) , and which acts in accordance with the law of February 16, 2007 on competition and consumer protection (Journal of Laws from 2007 No. 50, item 331). The organization of the office is determined by the statute issued by decree by the President of the Council of Ministers (MP from 2007 No. 39).

history

The first competition authority in the emerging Polish market economy was the Minister of Finance, who carried out his actions in the field of protecting the national market and its participants from monopoly practices of economic units, including what he was given by the law of January 28, 1987 on counteraction of monopoly practices in the national economy (Journal of Laws from 1987 no. 3, item 18) used competencies awarded.

In order to guarantee the development of competition , the protection of economic entities exposed to the application of monopoly practices, as well as the protection of consumer interests , the Antimonopoly Office ( pl.Urząd Antymonopolowy ) was appointed according to the law of February 24, 1990 on counteraction of monopoly practices . The antimonopoly office as the central organ of the state organization for counteracting monopoly practices was dependent on the Council of Ministers . The previous law was repealed, and as a result the Minister of Finance lost the authority of the anti-monopoly body in favor of the anti-monopoly office.

In 1996 the Antimonopoly Office was renamed the Office for Competition and Consumer Protection (pl. Urząd Ochrony Konkurencji i Konsumentów ).

President of the Office

The President of the Office for Competition and Consumer Protection (pl. Prezes Urzędu Ochrony Konkurencji i Konsumentów ) is the central body of the government administration responsible for competition and consumer protection in Poland. The President of the Council of Ministers oversees the activities of the President of the Office.

The President of the Office is:

  • the body that carries out the tasks assigned to the government of the Member States of the European Union, in accordance with Articles 84 and 85 of the EC Treaty. Above all, the President of the Office is the competent body for the protection of competition according to Article 35, Regulation No. 1/2003 / EC,
  • Liaison office within the meaning of the provisions of Regulation No. 2006/2004 / EC and in the area of ​​its legal powers is the competent body referred to in Article 4 (1) of Regulation No. 2006/2004 / EC.

The President of the Council of Ministers both appoints and removes the President of the Office. Removed president of the office serves until the appointment of the successor.

Organizational units

The President of the Office carries out his duties with the help of the Office for Competition and Consumer Protection. The President manages the office with the help of the Vice-President, the General Director, the directors of the organizational units set out in § 4 (1) of the Law (Organizational Units of the Headquarters) of the annex to the decree of the President of the Council of Ministers of April 20, 2007 regarding the conferment of statutes for the office for competition and consumer protection (Journal of Laws from 1987 No. 3, Item 18).

The office includes the headquarters in Warsaw and 9 regional representations in:

  • Bydgoszcz - Voivodeships: Kujawsko-Pomorskie and Warmińsko-Mazurskie,
  • Gdańsk - Voivodeships: Pomorskie and Zachodniopomorskie,
  • Katowice - Voivodeships: Śląskie and Opolskie,
  • Kraków - Voivodeships: Małopolskie and Podkarpackie,
  • Lublin - Voivodeships: Lubelskie and Podlaskie,
  • Łódź - Voivodeships: Łódzkie and Świętokrzyskie,
  • Poznań - Voivodeship: Wielkopolskie,
  • Warszawa - Voivodeship: Mazowieckie,
  • Wrocław - Voivodeships: Dolnośląskie and Lubuskie.

At the office, the auxiliary company also functions as a separate unit in terms of finance and organization.
