The Prime Minister of Poland ( Polish Prezes Rady Ministrów - Chairman of the Council of Ministers shortly Premier , so often abroad Prime Minister called) is the head of the government . Acting Prime Minister is Mateusz Morawiecki .

Competencies and powers

According to Articles 148, 149 and 161 of the current 1997 constitution , the Prime Minister has the following powers and powers:

  • he represents the Council of Ministers
  • directs the work of the Council of Ministers
  • issues statutory ordinances
  • ensures the implementation of the policy of the Council of Ministers and determines the manner of its implementation
  • coordinates and controls the work of the members of the Council of Ministers
  • oversees local self-government within the limits and forms set by the constitution and laws
  • is the superior of all government officials
  • assigns tasks to the individual ministers
  • can apply to the Council of Ministers to repeal ordinances or orders issued by an individual minister
  • proposes to the President to make changes to the composition of the Council of Ministers

Appointment and election

According to Article 154 of the Constitution, the President of the Republic of Poland appoints the Prime Minister, who then proposes the members of the Council of Ministers. The President must convene the Prime Minister and the members of the Council of Ministers to take their oath within 14 days of the Sejm's constitution . Within 14 days of the appointment by the President, the Prime Minister presents the work program of the Council of Ministers to the Sejm and requests that he express his confidence . The confidence is expressed by the Sejm with an absolute majority of votes in the presence of at least half of the legal number of MPs .

If the Prime Minister is not convened by the President within the deadline or if the Sejm does not trust him, the Sejm elects a Prime Minister and the members of the Council of Ministers proposed by him within 14 days after the two 14-day deadlines Majority of votes. The President then again convenes the Prime Minister and the members of the Council of Ministers to take their oath.

If a newly elected Sejm meets, then the current Prime Minister must offer the resignation of the Council of Ministers according to Article 162 of the Constitution. The President then accepts the resignation of the Council of Ministers and obliges it to continue the official business until the appointment of the new Council of Ministers. The President can also refuse to accept the resignation of the Council of Ministers if the Prime Minister should additionally offer his own resignation.

Oath of office

According to Article 151 of the Constitution, the Prime Minister, his deputies and the Ministers must take the following oath before the President of the Republic of Poland :

“I take up the post of Chairman of the Council of Ministers (Deputy Chairman of the Council of Ministers, the Minister) and solemnly swear that I will remain faithful to the provisions of the Constitution and the law of the Republic of Poland and that the welfare of the Fatherland and the welfare of citizens will always be my highest duty. "

The following sentence can also be added to the oath:

"Tak mi dopomóż Bóg."

"So help me God."

Motion of no confidence and resignation

The requirements for a motion of censure are set out in Article 158 of the Constitution. According to this, at least 46 MPs can put a motion of no confidence in the Sejm and at the same time have to nominate a new candidate for the office of Prime Minister. The motion is deemed to have been accepted if the majority of the legal number of MPs has voted for it. An application can be submitted for voting no earlier than 7 days after it has been submitted. A new application is possible no earlier than 3 months after the previous application has been submitted.

If the vote of no confidence is successful, the entire government has to resign and the president appoints the new prime minister. The latter then has to face the question of confidence with his cabinet in the Sejm. Should no new government gain the confidence of the Sejm, new elections must take place, which are scheduled by the president.
