The Constitutional Council of Kazakhstan ( Kazakh Қазақстан Конституциялық Кеңесі, Russian Конституционный совет Республики Казахстан , which is a constitutional body in terms of the supervision of the constitution, judiciary in Kazakhstan ) is a constitutional body , which regulates the supervision of Kazakhstan's constitution . After the Constitution of Kazakhstan from 1995, the Constitutional Council replaced since the Constitutional Court of Kazakhstan.

Formation of the Constitutional Council

The Constitutional Council consists of 7 members. The President of Kazakhstan appoints the chairman, Qairat Mämi since 2017 , and two other members of the Constitutional Council. The Senate and Mäschilis each elect two members. Members are convened for six years, with half of the members being replaced in three years. The former presidents (none yet) are members of the Constitutional Council until their death.

Function of the Constitutional Council

The President, the chairman of the Senate, the chairman of the Maschilis, no less than a fifth of the total number of deputies in parliament, the prime minister or a court (in the event of a violation of the constitution or human and civil rights) can appeal to the Constitutional Council.

According to Article 72 of the Constitution of Kazakhstan, the Constitutional Council has the following tasks:

  • Review of the conduct of the election of the President, MPs and Republican referendums
  • Review of Parliament's legislative proposals
  • Verification of compliance with the constitution by parliament and its chambers
  • Verification of compliance with international treaties before ratification
  • Showing the correct use of the constitution
  • Opinion on compliance with the exemption or dismissal of the President from office (no special convocation of the Council necessary)
