The Association of Administrative Judges (VRV) is a professional association based in Vienna ( Austria ) and a member of the Austrian umbrella association of administrative judges . Administrative judges association is a self-designation, according to the central register of associations the association name is: Association of members of the administrative courts .

The VRV has chosen the motto in the logo: Iuris praecepta sunthaec - honeste vivere, alterum non laedere, suum cuique tribuere . of the lawyer Ulpian . This corresponds to the beginning, in the first part of the Corpus Iuris Civilis in the institutions of Emperor Justinian : iuris praecepta sunt haec: honeste vivere, alterum non laedere, suum cuique tribuere . - The commandments of law are these: live honorably, do not hurt others, grant each his own.

history

Through a constitutional amendment in 1988 and corresponding state laws , Independent Administrative Senates (UVS) were set up as more or less independent authorities with judicial authority to control the administrative activities of the federal states. The UVS began its work on January 1, 1991. The introduction was necessary because Articles 5 and 6 of the European Convention on Human Rights (ECHR) had not been complied with in Austria by this time.

In May 1993, an Austria-wide professional representation for UVS members was founded with the support of the Association of Austrian Judges and the Association of Administrative Judges in Graz. The decision to found its own specialist journal and hold annual specialist conferences is subsequently made.

In 2012, a change in the administrative jurisdiction in Austria was resolved and on January 1, 2014, all independent administrative panels were dissolved and replaced by regional administrative courts . As a result, the UVS Association became the Association of Administrative Judges (VRV).

Goal and purpose of the association

According to no. 3 of the association's statutes the following aims and purpose (quote):

  • Promotion and further development of administrative jurisdiction in Austria.
  • Comprehensive representation of the professional interests of the members of the administrative courts, including social and cultural issues, in particular with regard to the development of a uniform image of judges in Austria as well as the creation of uniform service and salary law.
  • Promotion of all efforts for the jurisprudential processing of the legal areas relevant for the work of the administrative judges as well as an exchange of views on them.
  • Coordination with other judicial advocacy groups and professional associations at national and international level
  • Creation of a training and further education facility for administrative judges; Participation in European training programs
  • Promote permeability between the courts.

These purposes are to be achieved in particular through the establishment and maintenance of contacts between the administrative courts and all relevant bodies and through the submission of suggestions for optimizing working conditions at the administrative courts in connection with appropriate public relations work. If necessary, scientific, cultural and social events should also be held.

membership

Membership in the VRV is divided into ordinary and extraordinary members. Ordinary members can be all judges of active service at an Austrian administrative court. Extraordinary members can be all persons who are interested in fulfilling the purpose of the association, in particular former full members.

The duties of the ordinary and extraordinary members of the association are:

  • outwardly to perceive the interests of the association in their entire behavior and
  • To keep quiet about internal association matters
  • to pay the membership fee determined by the General Assembly.

The VRV is itself a member of the umbrella association of administrative judges .

Association organs

The organs of the association are the general assembly, the board of directors, the association arbitration tribunal and the cash auditors. Interestingly, the statutes regulate the board of directors prior to the general assembly that is superordinate to it.

General Assembly

Seat, vote and the right to submit applications only have full association members. The ordinary general assembly has to take place once a year. An extraordinary general assembly can take place by resolution of the board of directors or at the request of one tenth of the association members or - if the establishment of sections has been decided - at the request of half of the section leaders

The general assembly decides on all matters that are not assigned to another organ of the association for decision, in particular on the amount of the annual membership fee and amendments to the statutes as well as the dissolution of the association. The general assembly is also responsible for electing, dismissing and discharging the board or individual board members, the association arbitration tribunal and the cash auditor.

Board

The board consists of a president and two vice-presidents as deputies, a treasurer and a secretary. The members of the board of directors should belong to different administrative courts and are elected for one year. If the general assembly decides to set up sections, the respective section head takes part in the board meetings without voting rights. Only full members can be elected to the board.

The president represents the association externally, unless there are sections. The board of directors makes its decisions with a simple majority and has a quorum if at least half of the board members are present.

The current president is Siegfried Königshofer (Administrative Court Vienna), Vice-Presidents are Gudrun Kurz (Administrative Court Lower Austria) and Gerold Dünser (Administrative Court Tyrol).

Association arbitration court

The association arbitration tribunal consists of three members elected by the general assembly and three substitute members. These are elected for a period of three years. Members of the association's executive board and cash auditors are excluded from working in the association's arbitration court.

The association arbitration court decides on all disputes arising from the association relationship, in particular on the contestation of the exclusion of an association member.

Cash auditor

The auditors are appointed for one year by the general assembly. They are responsible for checking the financial management of the association.
