Directory of nationally valuable cultural assets

In Germany since 1919, directories of cultural goods that are particularly worthy of protection are called directories of nationally valuable cultural assets . It is characteristic that cultural goods entered in these registers are subject to export restrictions.

The legal basis for the creation of such registers was initially the Reich Ordinance on the Export of Works of Art of December 11, 1919. After the end of the Second World War, this system was adopted with the law on the protection of German cultural property against emigration of August 6, 1955. By virtue of this law, all German federal states each kept a directory of nationally valuable cultural assets and a directory of nationally valuable archives . The highest state authorities, which had to hear an expert committee beforehand, decided on the entry. The Federal Government Commissioner for Culture and the Media created corresponding general directories from the individual state directories . With the Cultural Property Protection Act of July 31, 2016, the separation of the registers for archives and cultural property was abandoned.

The requirements for the entry of a cultural property in the register of nationally valuable cultural property are regulated in § 7 KGSG. After that, a cultural asset is registered if it

"Is particularly significant for the cultural heritage of Germany, the federal states or one of its historical regions and thus identity-creating for the culture of Germany and its emigration would mean a significant loss for the German cultural heritage and therefore staying in the federal territory is in the outstanding cultural public interest."

The possibility of registering cultural assets is therefore limited to individual, particularly outstanding works.

A procedure for the registration of a cultural property is only initiated upon application , whereby such an application can only be made by the authorities and the owner. In particular, museums that are merely owners of such cultural assets cannot apply for registration.
