Victorvox and consumer protection

In the past, Victorvox made a name for itself with its idiosyncratic appearance towards customers and consumer advocates. Essentially, Victorvox has become noticeable with three major incidents in recent years:

  • illegal deactivation fee (2001)
  • the faircom affair (2003)
  • the MoobiCent throttles (2007)

In 2001 the consumer advice center had to declare a deactivation fee to be inadmissible before the Düsseldorf Regional Court and the Düsseldorf Higher Regional Court . The company had previously received several warnings on this matter. Before the Federal Court of Justice , the Federal Association of Consumer Organizations also received the right in a different procedure. With a judgment of April 18, 2002, it was decided that the clause on the deactivation fee is inadmissible if the mobile phone contract is terminated in accordance with the contract. Furthermore, a proxy lawsuit was won for repayment of the deactivation fee.

In 2003, Victorvox was noticed in connection with the insolvent broker Faircom. This involved coupling transactions between Premiere subscriptions and Victorvox mobile phone contracts. Faircom's idea was to broker mobile phone contracts and Premiere subscriptions at the same time. Part of the commission for the placement of the telephone contract was passed on to the customers (for the purpose of settling the monthly basic fees). After Faircom went bankrupt, payment defaults occurred, so that the basic fees due had to be paid by the customer himself. In their distress, some customers then terminated their contracts. While Premiere released the Faircom victims from their contracts without hesitation, Victorvox was less insightful. According to the WDR, Victorvox expressed the following in a letter: “Please note that the lack of basic fee exemptions that you have complained about cannot be taken over by Victorvox AG. Regrettably, we are also unable to comply with a termination issued by you in this context. "
