On March 27, 2011, a referendum took place in Hesse to include the debt brake in the Hessian state constitution . It was held at the same time as the local elections in Hesse in 2011 . The constitutional amendment was passed with seventy percent. The next referendums in Hessen were the 2018 referendums in Hessen .

Referendum

On December 15, 2010, the Hessian state parliament passed the law amending the constitution of the state of Hesse . This law provides for the debt brake to be included in the Hessian state constitution. The debt brake limits the state of Hesse's indebtedness and prohibits new indebtedness from 2020.

In order to change the Hessian state constitution, a referendum is necessary according to Article 123, paragraph 2 of the constitution of the state of Hesse . According to the law on referendums, the Hessian state government set March 27, 2011 as the day of the referendum on December 22, 2010.

A brochure from the Land Returning Officer was sent to the citizens entitled to vote with the voting notifications . This brochure provides explanations of the referendum. The Left Party in the Hessian state parliament failed on December 15, 2010 with the attempt to include not only advantages of the debt brake in this brochure, but also disadvantages. This change was rejected by the parliamentary groups of the CDU , the SPD , the FDP and the Greens . Thereupon Die Linke sued the State Court of Hesse because it saw this brochure as a violation of basic democratic principles. On March 9, 2011, the State Court rejected the left's action. The judges justified their decision by stating that a decision in favor of the Left's action would be a massive interference with an ongoing process. The judges in the main proceedings decided on the principle of the action with a judgment of 9 October 2013 rejecting the application.

Results of the referendum

The referendum was accepted by the voters with 70.0%. The amendment to the constitution was announced on April 29, 2011 in the Law and Ordinance Gazette for the State of Hesse and came into force on May 10, 2011. The debt brake has since been codified in Article 141 of the state constitution.
