The Election Statistics Act (WStatG) is the legal basis in Germany for the statistical analysis of federal and European elections .

The WStatG differentiates between “general election statistics” and “ representative election statistics ”. The "general election statistics" are to be carried out in compliance with voting secrecy , the evaluation is to be published ( § 1 WStatG). Likewise, while maintaining voting secrecy, the results of the “general election statistics” must be used to compile the “representative election statistics” based on random samples of electoral districts according to the survey and auxiliary criteria specified in the law . The publication of the results of the “representative election statistics” is subject to the restrictions formulated in Section 8 of the WStatG. In addition, the WStatG regulates the responsibilities for the implementation and publication of election statistics.
