According to the Water Resources Act (WHG) in force in the Federal Republic of Germany, water-endangering substances are "solid, liquid and gaseous substances that are capable of causing permanent or not insignificant changes in the water quality". According to the Austrian Water Law Act (WRG) § 31a Paragraph 1 Clause 2, substances are hazardous to water "which, due to their harmful properties for humans or aquatic animals or plants, in particular due to toxicity, low biodegradability, accumulation ability, sensory effects and mobility, when exposed on bodies of water whose ecological status or usability, especially for water supply, are able to sustainably impair ”.

Affected substances

In Germany, water-polluting substances were listed in the General Administrative Regulation for the WHG on the classification of water-polluting substances in water polluting classes (VwVwS) of July 27, 2005 ( Federal Gazette No. 142a of July 30, 2005) of the Federal Environment Ministry . The term substance also includes preparations , now called mixtures .

In addition, the in are (to § 13, paragraph 1) list of hazardous pollutants and emissions groups Appendix 7 and Appendix 8 (to § 13, paragraph 2) list of other pollutants and groups of pollutants of ground water regulation substances listed (GrwV) hazardous to water.

classification

Substances hazardous to water are classified in the following water hazard classes:

  • Water hazard class 1: slightly hazardous to water,
  • Water hazard class 2: clearly hazardous to water,
  • Water hazard class 3: highly hazardous to water.

As a result, every substance is considered hazardous to water that is not determined by the administrative regulation or in a procedure described therein as not hazardous to water .

Legal situation

In Germany, Section 62 (4) number 1 WHG authorizes the Federal Government to regulate in more detail by means of a statutory ordinance pursuant to Section 23 (1) WHG “the determination of water-polluting substances and their classification according to their hazardousness” as well as “through the involvement of the Federal Environment Agency and other bodies” . This happened through the ordinance on systems for handling water-polluting substances (AwSV) of April 18, 2017. In addition, regulations of the federal states on systems for handling water-polluting substances may have been issued.

In Germany, the passage of vehicles loaded with substances hazardous to water may be prohibited by sign 269 in water protection areas .

Principles

The principle of the AwSV in Germany is the impermeability requirement, which is intended to prevent water-polluting substances from escaping from systems. For this purpose, the corresponding technical requirements for the impermeability of surfaces are declared binding. Further requirements concern stability, resistance to impairments of all kinds, measures to detect leaks and the creation of collection volumes.
