Interim committee

The Interim Committee is in Bavaria a political committee , which the parliament until the convening of the new parliament appointed for the period after the last session of an electoral period and after the dissolution or the dismissal of the parliament and called as required by State Parliament President to the rights of parliament to protect against the state government and to be able to deal with urgent state affairs. The powers and duties of the interim committee are regulated by Articles 26 and 32 of the Bavarian Constitution and Articles 20 to 22 of the Rules of Procedure of the Bavarian State Parliament.

This committee has the powers of the state parliament, but can neither bring ministerial charges, pass laws, nor deal with plebiscites . The size of the committee is determined by the state parliament, whereby the seats are allocated to the parties represented in the state parliament according to the strength of the parties. Each political group must be represented on the committee; The Sainte-Laguë / Schepers method is decisive for the distribution. The members are proposed by the individual political groups, and a deputy is appointed for each committee member.

The President of the State Parliament and the Vice-Presidents cannot be appointed to the interim committee, since the President of the State Parliament, according to Article 44 of the Bavarian Constitution, takes over the external representation of the Free State after the Prime Minister's resignation .

The interim committee has only been convened three times in the history of the Bavarian State Parliament since 1946:

  • on June 21, 1951 for the constitution of the interim committee,
  • on July 11, 1951 to expand the Hammelburg military training area,
  • on November 17, 1958 for the establishment of a commission to examine state guarantees,
  • on July 30, 1982 due to a secret service affair of the head of the Bavarian State Security Hans Langemann ,
  • on October 10, 1990 as a result of the allegation of illegal arms deliveries to Iraq by the arms company Messerschmitt-Bölkow-Blohm ,
  • on October 16, 2008 in the context of the international financial crisis

In the state of Rhineland-Palatinate , the corresponding body is called the “ Standing Committee ”.
