Alois Birklbauer

Alois Birklbauer (born April 3, 1965 in Hofkirchen im Traunkreis , Upper Austria ) is an Austrian lawyer and professor at the Johannes Kepler University (JKU) Linz . He is head of the Department of Criminal Law Practice and Medical Criminal Law.

Life

After graduating from high school, Birklbauer first studied theology at the Catholic Private University in Linz. He then studied law at the University of Vienna and then at the JKU Linz, where he received his doctorate in 1998 . Since 1994 Birklbauer has worked as a university assistant at the Institute for Criminal Law , Criminal Procedure Law and Criminology at the JKU Linz, and from 2004 as an assistant professor. In 2009 Birklbauer was awarded the license to teach criminal law and criminology. In summer 2009 he was appointed university professor at the Institute for Criminal Law and since autumn 2009 he has been head of the Department for Practice of Criminal Law and Medical Criminal Law at the JKU Linz.

Birklbauer is also active in numerous non-university committees. Since 2000 he has been a member of Parliament's Criminal Law Commission on the subject of "The reaction to criminal behavior in Austria, its appropriateness, its efficiency, its balance". In 2003 and 2004 he was called in as an expert in the Justice Subcommittee to advise on the 2004 Criminal Procedure Reform Act. Since 2006 he has been a member of the Prison Commission for Upper Austria and since 2007 a member of the Human Rights Advisory Board at the Federal Ministry of the Interior. Since October 2008 he has been the editor of the journal for criminal law.

Birklbauer was also active in lobbying. From 1999 to 2000 he was a member and first deputy chairman of the departmental committee for university teachers at the JKU Linz, and from 2000 to 2010 he was chairman of the works council for scientific staff at the JKU Linz.

Birklbauer is a member of the SPÖ party, but currently has no political function in the party.

Alois Birklbauer is married to Michaela Obereigner and lives in Linz.

Main focus of work and research

In addition to general research dogmatic topics, Birklbauer also deals with legal fact research. In collaboration with colleagues, there are numerous empirical publications on the practical application of criminal law , such as B. for conditional imprisonment and conditional release. In addition, there is an extensive investigation into the implementation of the new criminal procedure law in cooperation with colleagues . Birklbauer is currently working on an interdisciplinary study on shoplifting among children and adolescents - determinants and prevention, as part of a Sparkling Science project.
