The waste oil ordinance (AltölV) regulates the recycling (material and energy) and the disposal of waste oil in the Federal Republic of Germany. The term used oil from mineral oil, synthetic or biogenic oil is understood to mean substances and mixtures existing, provided that they are waste within the meaning of Section 3 (1) of the Recycling and Waste Management Act (KrW- / AbfG).

The waste oil ordinance was published in the Federal Law Gazette on October 27, 1987 ( Federal Law Gazette I p. 2335 ) and came into force on November 1, 1987 . The last change came into effect on June 1, 2012.

Purpose of the law

The purpose of the waste oil ordinance is to expand waste law, in particular waste recycling measures, through the Recycling and Waste Management Act (KrW- / AbfG). The ordinance specifies in particular the priority of processing over other types of recovery. In order to facilitate processing, used oils must be collected separately (“prohibition of mixing”). Used oils may only be reconditioned if they contain less than 20 mg / kg of the polychlorinated biphenyls (PCBs) classified as toxic and carcinogenic and less than 2 g / kg total halogen. In 2011, around 84 percent of the waste oils collected were recycled.

Collective categories

To simplify the collection, transport and, as far as possible, the processing of used oils, these are classified into one of four collection categories. The following list names the most important representatives of the four categories:

  • Collective category 1: non-chlorinated machine, gear and lubricating oils
  • Collective category 2: halogen-free hydraulic oils
  • Collection category 3: halogenated or chlorinated oils
  • Collection category 4: biodegradable oils, oils from oil / water mixtures, heating oils and diesel fuels
