Buildable land area
The Überbaubare Land area (also building windows , construction site ) referred to in the Land Use Ordinance that part of a building plot , on which according to the stipulations of the development plan and in compliance with the relevant building code regulations , a building or buildings with the permissible measure of structural use may be erected.
The area is shown graphically in the development plan and delimited by building boundaries and, if necessary, building lines (including alignment lines ). The form of the graphic representation is regulated in the Planzeichenverordnung (PlanzV).
The construction window deliberately limits the building possibilities of a property in order to achieve a planned positioning of buildings and is based on urban planning considerations.
The building depth, which is also regulated in the Building Use Ordinance, is the maximum depth of the plot of land that can be built over. It specifies how far a plot of land can be built on from the road that connects the plot “to the rear”. These stipulations are legally binding for main buildings (i.e. without ancillary buildings such as garages).
In addition to the building depth, the construction method is also regulated. This concerns the way in which buildings may be arranged taking into account the property boundaries.
Building limit
The building boundary is the line defined or drawn in the development plan, which buildings or parts of them may not be overbuilt. If only a building boundary and no building line is defined, the building can be freely positioned within this building window in accordance with legal guidelines, such as the required spacing areas.
A step forward of parts of the building to a small extent can be permitted (Section 23 Paragraph 3 Sentence 2 BauNVO).
Construction line (alignment)
In contrast to the building boundary, the building must not lag behind the building line, but the relevant outer wall must lie exactly on the building line. The aim of a building line is usually to achieve a continuous line of houses on the street side. Former names for the building line are building line and building edge .
