Tree crime
Under Tree crime is defined as the unauthorized intentional damage or precipitation by trees.
Tree crime is often attributable to undirected vandalism , but sometimes targeted actions are taken against unpopular street or park trees .
Legal situation
Germany
In Germany, tree crime can be punishable as damage to property . In addition, a tree protection statute may apply.
Switzerland
If the intervention on the tree is not covered by the capping law ( Art. 687 Para. 1 ZGB ), such interference can be assessed as damage to property and compensation for damages according to Art. 43 Para. 1 OR can be legally claimed.
history
The Teutons knew tree sanctuaries , the damage of which could be a serious offense. The punishment, however, did not have to be carried out by humans, but could be imposed as a threat of divine punishment. When Boniface felled the Donar kingdom at Geismar as a symbol of paganism in 724 , but the punishment of the gods did not materialize, this was a stage victory in Christian missionary work.
In the Middle Ages, wicked people were threatened with painter trees (= "fat trees"), the fruits of which were edible for humans or were used to fatten pigs ( acorns - see acorn fattening , beechnuts ), sometimes draconian punishments such as cutting off hands.
