Bavarian Child Education and Care Act

The Bavarian Child Education and Care Act (BayKiBiG) of the Free State of Bavaria is a state law that was passed by the Bavarian State Parliament in 2005 . The main goals are

  • the needs-based expansion of childcare and
  • quality development and assurance in the field of support.

The BayKiBiG competes with the federal social security code (SGB), in particular with the eighth book (SGB VIII, on child and youth welfare) and the twelfth book (SGB XII, on social welfare). The BayKiBiG was supplemented by the "Ordinance on the Implementation of the Bavarian Child Education and Care Act (AVBayKiBiG)" of December 5, 2005 (GVBl. P. 633)

The BayKiBiG is divided into

  • the general provisions (scope, terms, carriers, general principles),
  • securing and planning (securing a sufficient supply of care, planning responsibility, local and regional planning process),
  • securing the best interests of the child (operating and care permit),
  • education and upbringing work (including mandate for education , upbringing and care, integrative work, principles for educational and upbringing goals, cooperation between the institutions and parents, networking of the institutions / cooperation with the primary school, care in day care, scientific support, advanced training ),
  • Financial support (including entitlement to support , requirements for support, scope of entitlement to support, regulations for guest children, rural areas, procedures, support for investment costs, approval authorities, responsibility)
  • and the experimentation clause and implementation regulation.

The AVBayKiBiG regulates and standardizes

  • the educational and upbringing goals (child protection, ethical and religious education and upbringing, emotionality and social relationships, linguistic education and support, mathematical education, scientific and technical education , environmental education and upbringing, information technology education, media education and upbringing, aesthetic, visual and cultural education and upbringing, musical education and upbringing, physical education and promotion, sport, health education and the tasks of educational staff),
  • the minimum personnel requirements (skilled workers, pedagogical staff, employment key) and
  • child-related financial support (day care workers, booking time factors, changes taking effect, networks for children, rural kindergartens).

Individual BayKiBiG articles were controversial even during the legislative process. Hundreds of petitions were submitted to the Bavarian State Parliament. The central associations of the independent organizations of day-care centers also demanded improvements to the law, albeit unsuccessfully. In particular, the design of the financial support (guest child regulation and determination of needs, weighting factors for child-related subsidies with different requirements) still cause some annoyance among the institution providers as well as pending proceedings in the Bavarian administrative courts.
