Advisory State Committee (Greater Hesse)

The Advisory State Committee of Greater Hesse was a body set up after the Second World War , in February 1946, which consisted of 12 members each from the SPD , CDU , KPD and LDP and acted as a kind of preliminary parliament. It corresponded to the appointed state parliaments of other federal states and was the predecessor of the Hessian state parliament .

On September 19, 1945, General Dwight D. Eisenhower's Proclamation 2 formed the states of " Greater Hesse ", " Württemberg-Baden " and " Bavaria ". As a first step, Colonel James R. Newman ordered the formation of a civil state government for Greater Hesse in "Organizational Instructions No. 1" of October 12, 1945. At the suggestion of the Department of Civil Administration (CAD) of the US Army , the non-party lawyer Karl Geiler was appointed first Prime Minister.

In agreement with the military authorities, Prime Minister Geiler issued the "Basic State Law of the State of Greater Hesse of November 22, 1945", Article 9 of which described the necessity of drafting a constitution and the appointment of an advisory state committee.

The composition and selection of the MPs was highly controversial. Ultimately, an equal representation of the state committee was implemented from the 4 approved parties KPD , SPD , CDU and LDP . Each of these parties submitted a list of 20 candidates to Prime Minister Geiler, of whom he selected 12. This procedure was based on a proposal by the chairmen of these parties from a joint meeting on November 30, 1945.

The partial local elections held in January 1946 resulted in 44% for the SPD and 31% for the CDU, while the KPD with 5% and the LDP with 3% were beaten. The SPD took this as an opportunity to question the equal representation, but could not prevail. The withdrawal of the SPD ministers from the Geiler government was not approved by the military authorities.

By letter of February 19, 1946, Geiler appointed the members of the advisory committee. The Advisory State Committee met four times: The opening session, which took place on February 26, 1946 in the presence of all ministers of the Hessian Cabinet, was followed by a two-day working session on March 28 and 29, a shorter working session on May 21, and a Finally, on June 6th and 7th, a two-day closing session. In addition to the plenary, the state committee's work also took place in a total of nine committees, of which only the executive committee, which consisted of four representatives each from the SPD and CDU and two each from the KPD and LDP and acted as a kind of parliamentary presidium, and the Finance Committee and the Economic Policy Committee should become more important.

The Advisory State Committee had neither legislative nor actual control powers over the government. Rather, the legislative competence rested exclusively with the Prime Minister and required the consent of the military government.

With the election of the state assembly advising the constitution on June 30, 1946, the mandate of the state advisory committee ended.
