Professional association regulations

The trade association regulations (BGV) are the accident prevention regulations issued by the German trade associations . These regulations apply to all employees in the Federal Republic of Germany and deal with all aspects of health protection such as B. the principles of prevention, first aid in the event of accidents at work, the design of workplaces and the activities of specialists for occupational safety and company doctors.

In 2014, the BGV was combined as DGUV ( German Statutory Accident Insurance ) Regulations 1-84. With the DGUV regulations, the almost identical regulations of BGV A1 and GUV-V A1 have been repealed and converted into a regulation.

The DGUV regulations represent so-called autonomous law of the professional associations and are binding for the members of the professional associations.

The most important BG regulation is the DGUV regulation 1 - principles of prevention - which the old BGV A1 from 2004 once more "tightened" and replaced on August 1, 2014.

In principle, the accident prevention regulations are the result of the implementation of European framework directives (here 89/391 / EEC and 91/383 / EEC). The employers' liability insurance associations are responsible as lent authorities ((according to Section 1 (4 ) VwVfG ) and according to SGB VII) for the implementation of the laws resulting from the framework directive (the Occupational Safety and Health Act (ArbSchG), the Occupational Safety Act (ASiG) and the subsequent ordinances).

With the establishment of the world's first professional association in Germany around 1885, the combination of prevention and compensation and thus the first regulations for accident prevention emerged.

While accident prevention regulations (UVVen) still made clear guidelines for companies in the 1990s, many old accident prevention regulations were suspended in 2004 with the streamlining and the new nomenclature (e.g. BGV-A1). The responsibility for the detailed regulations covered by these regulations was returned to the entrepreneurs. The accident insurers realized that not every detail and every situation could be precisely described and regulated, quite apart from the supervisory measures. So consequently and in accordance with the European framework directive 89/391 / EEC on the implementation of measures to improve the safety and health protection of employees at work, the protection goals that the employer must ensure were defined.

The BG regulations are supplemented by the trade association rules (BGR) - since May 1, 2014 only called DGUV rules, the trade association information (BGI) and the trade association principles (BGG).

Since 2007, more and more UVVs (both BGV as well as BGR and BGI) have been withdrawn after they were replaced by the technical rules for operational safety . Double regulation was ruled out following an agreement between the employers' liability insurance association and the relevant specialist ministry ( Federal Ministry of Labor and Social Affairs ).
