Law on the basic qualification and further training of drivers of certain motor vehicles for the transport of goods by road or passenger (short professional driver qualification law , abbreviated BKrFQG). This law of 14 August 2006 regulates the professional qualifications of drivers and long-distance drivers and the further training of professional drivers in commercial road haulage and passenger transport in Germany and is an approximation of EU law ( Directive 2003/59 / EC). This is intended to improve the security be effected at motorists on the road through the mediation activities related skills and knowledge.

The qualification is also required for professional drivers who drive vehicles in the commercial sector for which a driving license of class C1, C1E, C, CE, D1, D1E, D or DE is required.

Basic qualification

The basic qualification can be acquired through

  • Vocational training to become a professional driver or specialist in driving operations, Section 4 (1) No. 2 BKrFQG
  • Passing an examination for the basic qualification, § 4 Abs. 1 Nr. 1 BKrFQG
  • the accelerated basic qualification, § 4 para. 2 BKrFQG

The training courses for the accelerated basic qualification usually contain the following content:

  • Safety rules for rational driving
  • Consumption-optimized driving
  • Safety equipment
  • Load securing
  • Social law framework for road haulage
  • Road traffic risks and accidents at work
  • Healthy in the workplace, ergonomics
  • React correctly in emergencies
  • Image-enhancing behavior
  • Market knowledge
  • Practical driving

The knowledge is proven by an examination (the theoretical examination lasts max. 240 minutes, the practical part of the examination lasts 30 minutes) and confirmed by a certificate ("Certificate of the basic qualification and further training for drivers in passenger transport according to Article 10 Para. 3 Letter b, third indent of Directive 2003/59 / EC of July 15, 2003 "). Furthermore, an entry with the code number 95 is made in the driver's license and in the driver's license register upon request .

Only recognized training centers are allowed to train and test, § 6 BKrFQV (except when the IHK tests).

The qualification must be repeated every five years (refresher training, § 5 BKrFQG).

further education

Since October 1, 2006, drivers who have received their C1, C1E, C, CE driving license before September 10, 2009 (acquis) must have taken part in a 35-hour training course by September 10, 2014 at the latest . For further training, Annex 1 of the BKrFQV provides that all contents of the three areas of knowledge must be proven through training. The driver selects five further training units from these:

  1. Improving rational driving behavior based on the safety rules
  2. Social regulations for freight transport and application of the regulations
  3. Health, traffic and environmental safety, services, logistics
  4. Switching point driver - image bearer, service provider, professional application of the regulations
  5. Improving rational driving behavior based on the safety rules

Exceptions

For example, drivers who do not require any basic qualifications or further training

  • Do not drive commercially (e.g. private journeys, journeys for non-profit organizations) Section 1 (2) No. 7 BKrFQG
  • as a craftsman transporting material or equipment that you use to exercise your profession, Section 1 (2) No. 5 BKrFQG
  • lead self-propelled machines
  • are deployed by the Federal Armed Forces, the troops and civil servants of the other contracting states of NATO, the federal and state police forces, the Federal Customs Administration as well as civil and disaster control and the fire brigade or are subject to their instructions, § 1 Paragraph 2 No. 2 BKrFQG.

Punishment

The Federal Office for Goods Transport is the competent administrative authority for punishing violations, Section 9 (4) BKrQFG. The fine is up to 20,000 euros.
